San Francisco Sunshine Ordinance Agreements


"Binding, written agreements by departments to comply with the law for all requesters in lieu of SOTF complaints are better for all involved: no hearings and the entire public instantly gets the benefit of the agreement instead of waiting for orders to be issued. More agencies have recently been wiling to negotiate agreements, and I encourage all City employees and officials to accept SOTF's various rulings. If any other department is willing to so negotiate, I am always open to considering such offers for all of my complaints (see here).

Members of the public: If the City isn't providing you exact copies of emails, with email addresses, BCC-s, hyperlinks, and (if you want them) detailed headers (see pg 3 of the attachment), I'd love to hear about it. Dear Task Force and Anonymous:

Regarding Anonymous’ offer to withdraw SOTF Complaint File No. 20006, the Office of the Mayor agrees generally (a) to produce exact PDF copies of public record emails for requesters (preserving any available non-exempt attachments, available non-exempt email addresses in the To/From/Cc/Bcc, and available non-exempt hyperlinks, images, formatting, and the body of the email), and (b) when specifically requested, to disclose full email headers of public record emails, subject to information security redactions of particular header values, and other lawfully￾applicable exemptions. We understand that following receipt of this letter and our production of non-exempt email header data for a July 2, 2019 email from Sophia Kittler to Andres Power, Anonymous will consider the issues in SOTF File No. 20006 resolved and withdraw the complaint.

Re: Whatsapp Records

Dear Anonymous:

This letter relates to issues raised regarding certain messages in the WhatsApp platform that were responsive to your request, characterized as an electronic communications audit from July of 2019, under the reference number 7434-706000365@requests.muckrock.com

Specifcally, we provided records responsive to that request from Communications Director Jeff Cretan that were messages in WhatsApp concerning an event with the Department of Emergency Management. You later sought certain embedded photos from those messages. We have provided those photos.

This letter is to confrm that I) we in the Mayor's Office possess the ability to retain and disclose as public records WhatsApp records that pertain to city business, including all attachments and inline images, that are maintained on the devices of Mayor's Office staff, including Jeff Cretan?s device and that 2) it will continue to be our practice to maintain such WhatsApp records in accordance with applicable retention polices and periods as set out in state and local record retention law and the Mayor's Office records retention policy and to disclose such records as appropriate in response to records requests pursuant to the Public Records Act and the Sunshine Ordinance.
